As I see it, the difference works in quite the opposite direction. Sawyer's crime was carelessness, not malignancy: he had no idea that Ana Lucia was plotting a murder and didn't act to bring one about. Both Ben and Locke did *precisely* that, which is why I consider them infinitely more culpable for Cooper's death than Sawyer could ever be considered for Ana Lucia and Libby's death. Both intended Cooper to die.

Same result. Locke wanted Cooper dead so he could follow Ben's trail, and he found a way to make it happen. At the very least, he's an accessory to a murder. And yes, Cooper did a lot of damage to Locke, but apparently not enough to drive him to a crime of passion. He went for a crime of callous calculation instead. I don't find that tremendously endearing myself.

Because Sawyer, for all his carelessness, didn't want Ana dead. Ben did want Cooper dead and acted with a view to bringing that about. Surely you can see the difference.
